A motion was made by F. Dirrgl to seat R. Peloquin as an alternate for the meeting. There was a second by L. Kouyoumjian. All in favor, thus the motion carries.

New Business
W2006-48 – Application to extend driveway and construct detached garage in Upland Review Area at 82 Schofield Rd (Map 43, Lot 29, Zone R80) Owner/Applicant: Stacey Thibodeau (Received 10/23/06, Public Hearing or Decision by 12/11/06)
The applicant and engineer were present to discuss the application. The engineer stated that currently there is an existing house and gravel driveway, the applicant is proposing that he build a detached garage and pave the driveway. He explained that there are wetlands in back of the house and to the side of the driveway which causes the entire lot to be in the regulated area.
G. Blessing asked why the garage is being built so far back. The engineer said that they were trying to keep it away from the existing swale, as well as provide enough room for cars to turn around in.
G. Blessing asked if the material for grading will be brought in. The engineer said that it will.
D. Schreiber asked if the garage will just have electricity not septic or water. The engineer said it will only have electricity. D. Schreiber asked what the distance from the disturbed area to the wetlands is. The engineer said that it is approximately 52 feet, which is there lawn. He stated that it will be reseeded after the project is completed.
The engineer stated that the existing driveway will remain the same, that it will just be paved.
G. Blessing asked if there were alternatives to the plan. The engineer said that the only other alternative would be to not build the garage or to not pave the driveway.
G. Blessing made a motion to remand the application to staff. L. Kouyoumjian seconded the motion, all members voted in favor, thus the motion carried.
W2006-49 – Application for a ruling of no jurisdiction for proposed subdivision on River Rd (Map 10, Lot 21-0A, Zone R80) Owner/Applicant: ~Willington River Corp. (Received 10/23/06, Decision by 12/11/06)
Henry Torcellini the applicants engineer was present to discuss the application. He explained that the property that they are discussing was once known as the Old Benton Estate. He stated that there is an existing house and 25 acres that was sold off and now they are proposing to cut out three building lots. Mr. Torcellini stated that one house is shown on the plans to show that it is a buildable area. Mr. Torcellini stated that the applicant is asking for no jurisdiction for lots one through four. He also went over the areas of wetlands which include above the lots near Baxter Road as well as near Clover Springs. He stated that there is a pipe that goes under Rt 32 to take run off.
G. Blessing asked where the drainage is on Rt 32. Mr. Torcellini said that all the water goes to a drain pipe and all the water drains next door.
G. Blessing asked why this part of the application is not being presented with the rest of the plan. Mr. Torcellini said that he will present the second part of the application this evening as well.
The commission stated that they did not want to make any decision on this application until the second part is presented.
The application was tabled.
W2006-51 – Application for Re-subdivision for (1) new lot on property at 167 Loshe Rd (Map 10, Lot 28, Zone R80) Owner/Applicant: Mike Marino (Received 10/23/06, Public Hearing/Decision by 12/11/06)
The applicant was not present and the application was received today so no decisions could be made.
W2006-56- Application for Commercial Timber Sale on property on Balazs Road (Map 44, Lot 3, approx. 211 acres) Owners: Barrie Robbins-Pianka & Chris F. Robbins; Applicant: Connwwod Foresters, Inc. contact: John O’Donnell, Forester (Received 10/23/06, Public Hearing or Decision by 12/11/06)
The applicant was not present and the application was received today so no decisions could be made.
W2006-57-Application to construct a common driveway and related grading in regulated area for (2) dwellings on Lohse Road (Map 46, Lot 1-B, Zone R80) Owner/Applicant D.W. Fish Home Builders, LLC. (Received 10/23/06, Public Hearing or Decision by 12/11/06)
Henry Torcellini the applicant’s engineer was present to discuss the application. He stated that the application was denied originally, but they have made changes and are presenting it again. Mr. Torcellini stated that there will be a common driveway to the first house and will spur off to the second house. There will be one driveway entrance with a squash pipe under it, filled with sediment at the crossing. There will be a level spreader and detention area as well the driveway will be down graded. This will allow no disturbance to the stream and less cutting in the surrounding area.
G. Blessing stated that there is no swale on the side of the driveway for storm water. Mr. Torcellini said that the water will sheet flow off of the driveway. G. Blessing asked if there is concern for ice on the driveway. Mr. Torcellini said that there will be less ice if there is not a swale.
The commission asked if the house and septic are still in the same place. Mr. Torcellini said that they are. The septic was able to be moved over slightly by moving the driveway.
The commission stated that they would like the town engineer to look over the plan and get back to them, as they can not make a decision today due to receiving the application today.
W2006-58- Application to construct single family dwelling & septic in Upland Review Area at 87 Luchon Rd (Map 18, Lot 13, Zone R80) Owner/Applicant: Robert Dempsy (Received 10/23/06, Public Hearing or Decision by 12/11/06)
Steven Phillip from Phillip Associates was present to discuss the application. He stated that the property was an existing site which had a trailer on it. The trailer burned down and there are two remaining paved driveways. Mr. Phillip stated that they are proposing to build a single family house on the property where the trailer was located and use the existing septic and well. He said that they would like to use one of the paved driveways and remove the other. Mr. Phillip said that they will use the pavement that they remove as fill.
The commission had concerns about what the DEP’s regulations are regarding using pavement as fill. They said that they will look into the regulations.
G. Blessing said that he would like to look at the property before they make a decision. The application was continued to the next meeting.
W2006-59- Proposed activity within regulated area for proposed 60 condo unit development on River Road (Map 10, Lot 21-A, Zone R80) Owner/Applicant: Willington River Corp. (Received 10/23/06, Public Hearing or Decision by 12/11/06)
Henry Torcellini the applicants engineer was present to discuss the application. Mr. Torcellini stated that he is proposing to build 63 two bedroom condos for an active adult community located at the corner of River Road and Baxter Road. He stated that the driveway will come from River Road and the septic and well will be located on the hill. The driveway will be a 24 feet coming down the hill at a 10% grade with storm drainage along Rt 32.
Mr. Torcellini said that he has been testing the soil for the past two and a half to three years. He stated that there are deep borings as they have watched for the past two springs. Mr. Torcellini said that ledge can be found fourteen feet below the ground. He stated that he has submitted the plan to DEP and received parliamentary approval.
Mr. Torcellini explained that the drainage area will be north and west of the property and will consist of a series of pipes that discharges to the east. He stated that the pipes meet the 100 year storm requirement; the septic system meets DEP requirements.
G. Blessing said that there will be a lot of run off during construction; he asked how the storm water will be dealt with. Mr. Torcellini stated that the official plan has not been developed yet, but will be built in phases.
F. Dirggil stated that he would like to see a construction plan with the phase information included.

W2006-60- Application for 3-lot Subdivision on corner of Daleville School & Busse Rds (Map 11, Lot 20, Zone R80) Owner/Applicant: S&P Ventures, LLC (Received 10/23/06, Public Hearing or Decision by 12/11/06)
No one present to discuss application as it was received tonight, no decision can be made.
Old Business
W2006-35 – Application for construction of a common driveway within upland review area on property at 49 & 53 Navratil Road (Map 14, Lots 41 & 41A) Owner/Applicant: ~Patriot Land Development, LL3/06)
Ronald Pooland was present to discuss the application. He submitted new plans as well as a memo from the town engineer. Mr. Pooland said that they have submitted several plans for a common driveway with an attempt for least disturbance to the wetlands. Mr. Pooland said that he has given all the drainage calculations to the town engineer and the soil scientist has submitted his report as well.
G. Blessing stated that he was concerned about storm water flow will at some point will begin to sheet flow and cross over lot 41.
Mr. Pooland said that there will be a swale on one side of the driveway which will lead the water to a culvert on Williams Road.
The commission went over the drainage calculations. Mr. Pooland said that he is aware that the town engineer made some recommendations regarding the calculations and he has no problems adjusting his plan to accommodate those.
G. Blessing asked if there has been septic approval from the Health District. Mr. Pooland said that they have.
G. Blessing made a motion to approve W2006-35 – Application for construction of a common driveway within upland review area on property at 49 & 53 Navratil Road with the following conditions:
1. With the driveways currently combined as shown on the latest revision, sedimentation fencing and hay bales are sufficient for the purpose intended.
As previously mentioned, no?silt fence or other sedimentation and erosion control measures should be removed prior to a final inspection by the Wetland Agent.
2. The common driveway paved detail has been eliminated; there does not appear to be any area of the current driveway at greater than 10%. Also, from the split at the common drive, each driveway length appears to be within the guidelines for emergency vehicle access; thus, no pull-outs would be required. I would recommend that a driveway detail be added, even if not paved, showing 12” of gravel and 3” of processed aggregate.
3. In areas not otherwise delineated by sedimentation and erosion controls, a line denoting limits of disturbance should be provided, particularly along the east and south sides of the areas to be cleared for development.
4. The driveway grading is revised to be directed to the swale going towards lot 41.
5. Note revised to include inspecting a minimum of weekly and prior to all storm events and check list to be submitted weekly.
Seconded by F. Dirrigl, all members voted in favor, thus the motion carried.
W2006-41- Application to construct a single family home, driveway and septic in the Upland Review Area at 57 Parker Road (Map 16, Lot 15-0B, Zone R80) Owner/Applicant: Norman Wilson (Received 9/11/06; -decision by 11/13/06)
Norman Wilson the applicant and his engineer Edward Pelletier were present to discuss the application. Mr. Pelletier stated that there is an existing house on the property and the applicant wishes to divide one parcel of land off for construction of another home.
Mr. Pelletier stated that there are several wetland areas and water courses on the property. The water course travels at 15%. He stated that the activity proposed in the regulated area is down graded from the wetlands.
Mr. Pelletier stated that the septic location has been accepted by the health district. He also stated that they will follow all of the town engineer’s suggestions.
G. Blessing asked for all sedimentation and erosion control issues to be included on the final plan.
G. Blessing made a motion to approve file W2006-41- Application to construct a single family home, driveway and septic in the Upland Review Area at 57 Parker Road with the following conditions that plans be revised to appear as technical revisions requested by engineer in 10/23/06 memo:
1. The lot is laid out in such a fashion as to minimize the amount of flow entering the road from the driveway. The proposed contours for the majority of the lot area indicate sheet flow for discharge. A check of the road drainage shows existing catch basins sufficiently spaced to avoid concentrated flow which could produce drainage problems along the road adjacent to the proposed parcel. To minimize additional drainage impact, I would recommend the layout of a narrow “rain garden” in the vicinity of the temporary loam stockpile and parallel to the 116-foot proposed contour.
2. Sediment fencing is shown on the downstream slope of the proposed building lot, including driveway, house and subsurface sewage disposal areas. Additional fencing should be shown on the proposed plan view surrounding the loam stockpile on Lot 1 (even though it is included in the detail on the following page).
No?silt fence or other sedimentation and erosion control measures should be removed prior to a final inspection by the Wetland Agent.
3. A footing drain has been identified for the proposed house on Lot 1. Its impact is expected to be minimal, but I would recommend a small formalized outlet so that its location will not be covered over time and, therefore, maintained.
4. Inspecting a minimum of weekly and prior to all storm events and check list to be submitted weekly.
Seconded by F. Dirggil, all members voted in favor, thus the motion carries.
Cease and Desist Order issued to Joseph Voboril Re: Clover Springs Subdivision Wetlands Permit #W2004-04 off Battye Road. Site Walk 10/24/05 9:30 a.m.
A site walk was scheduled for 11/4/06 at 9:00am.
File #2003-49 - Notice of Violation: ~Travel Centers of America (the Lessee) and George Giguere of Royce Properties (the Owner) of property located at 327 Ruby Road.
The commission discussed getting access to the website so they can monitor what is being done.
